By creating an account, accessing, or using GeopherAI's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and GeopherAI ("we," "us," or "our"). If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the modified Terms.

GeopherAI provides a Generative Engine Optimization (GEO) platform that helps brands optimize their online presence for AI-powered search engines including ChatGPT, Perplexity, Gemini, Claude, and other generative AI platforms. Our services include: • AI search visibility tracking and monitoring • Brand performance analytics across AI platforms • GEO and SEO readiness scoring • Competitor intelligence and analysis • Predictive traffic intelligence • Content optimization recommendations • Real-time ranking insights We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of services.

Account Registration: You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Account Security: • You must notify us immediately of any unauthorized use of your account • You are solely responsible for all activity conducted through your account • We are not liable for any loss or damage arising from unauthorized account access • You must not share your account credentials with third parties Account Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction to use our services. By creating an account, you represent that you meet these requirements.

You agree NOT to use GeopherAI services to: • Violate any applicable laws, regulations, or third-party rights • Engage in fraudulent, deceptive, or misleading practices • Distribute malware, viruses, or harmful code • Attempt to gain unauthorized access to our systems or other users' accounts • Scrape, harvest, or collect data from our platform without permission • Reverse engineer, decompile, or disassemble our software • Use our services to spam, harass, or send unsolicited communications • Interfere with or disrupt the integrity or performance of our services • Impersonate any person or entity or misrepresent your affiliation • Use automated systems (bots, scrapers) without explicit written consent Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

GeopherAI Ownership: All content, features, functionality, software, and technology on the GeopherAI platform, including but not limited to text, graphics, logos, icons, images, data compilations, and software, are the exclusive property of GeopherAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. User Content: You retain ownership of any content, data, or materials you submit to GeopherAI ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing and improving our services. Restrictions: You may not copy, modify, distribute, sell, or lease any part of our services or software without our explicit written permission.

Subscription Plans: GeopherAI offers various subscription plans with different features and pricing. By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase. Billing Terms: • Subscription fees are billed in advance on a recurring basis (monthly or annually) • All fees are non-refundable except as required by law or explicitly stated • We reserve the right to change our pricing with 30 days' notice • You authorize us to charge your payment method for all fees incurred • Failure to pay may result in service suspension or termination Free Trials: We may offer free trials for certain plans. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.

Termination by You: You may terminate your account at any time through your account settings or by contacting us at hello@geopher.ai. Upon termination, your right to use our services will immediately cease. Termination by Us: We reserve the right to suspend or terminate your account at any time, with or without notice, if: • You violate these Terms of Service • You engage in fraudulent or illegal activity • Your account remains inactive for an extended period • We discontinue the service Effect of Termination: Upon termination, you will lose access to your account and all associated data. We may delete your data in accordance with our data retention policies. No refunds will be provided for any remaining subscription period unless required by law.

SERVICE PROVIDED "AS IS": GeopherAI services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. No Guarantees: We do not guarantee that: • Our services will be uninterrupted, timely, secure, or error-free • Results obtained from using our services will be accurate or reliable • The quality of our services will meet your expectations • Any errors in our software will be corrected Third-Party Services: Our platform may integrate with third-party services (AI search engines, analytics providers). We are not responsible for the availability, accuracy, or content of these third-party services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEOPHERAI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR: • Any indirect, incidental, special, consequential, or punitive damages • Loss of profits, revenue, data, or business opportunities • Service interruptions or data loss • Damages resulting from your use or inability to use our services • Unauthorized access to or alteration of your content • Third-party conduct or content on our platform Our total liability to you for any claims arising from your use of our services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

We reserve the right to modify or update these Terms of Service at any time at our sole discretion. When we make changes, we will: • Update the "Last Updated" date at the top of this page • Notify you via email or through a prominent notice on our platform • Provide you with a reasonable opportunity to review the changes Your continued use of GeopherAI services after changes become effective constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must stop using our services and terminate your account. For material changes that significantly affect your rights, we will provide at least 30 days' notice before the changes take effect.
